Privacy and your personal information

By using myAMSA, you agree to AMSA’s collection, use, and disclosure of your personal information as outlined in AMSA’s Privacy Policy. We are committed to protecting your privacy and ensuring the security of your personal data.

Collection of information

AMSA will usually collect personal information directly from you or your authorised representatives. Sometimes, we collect personal information from third parties and you consent to AMSA doing this where reasonably necessary for any of the purposes described below or where:  

• you have consented to such collection
• we are required or authorised by law to collect information from someone other than you
• it is unreasonable or impracticable to collect the information from you.

We collect information by lawful and fair means.

Use and disclosure

Any personal information you choose to provide will only be used for the purpose for which it was provided. It will not be disclosed to other persons or organisations without your prior consent unless required or authorised by law.  

Your personal information will be collected, used and disclosed to enable AMSA to:  

• process applications for Certificates, which includes determining whether eligibility requirements for a Certificate are met
• manage payments for applications
• populate and manage accounts in myAMSA, including to update personal details
• send notifications and correspondence relating to accounts and Certificate records  
• conduct analysis and reporting related to the use of myAMSA
• perform functions under the Australian Maritime Safety Act 1990, Marine Safety (Domestic Commercial Vessel) National Law Act 2012 and Navigation Act 2012.

Use of myAMSA will require you to create and hold a digital ID under the Australian Government Digital Identity System (AGDIS).

AMSA will not disclose your personal information to any overseas recipients.

Access and correction

AMSA’s Privacy Policy includes information about how you can access or your correct your personal information.

Your responsibilities

Where AMSA suspects or becomes aware of a breach of these Terms of Use, AMSA may immediately revoke your access and deny you further access to myAMSA. You are responsible for:

1. Account security: You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. 
2. Accurate information: You agree to provide accurate and complete information when creating an account and using myAMSA. 
3. Compliance: You must comply with all applicable laws and regulations when using myAMSA.

Security measures

AMSA uses up-to-date techniques and processes to protect personal information against loss, unauthorised access, use, modification, or disclosure. However, users should be aware that there are inherent risks transmitting information across the Internet. Information submitted unencrypted via electronic mail or web forms may be at risk of being intercepted, read, or modified.

Limitation of liability

AMSA will not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the portal.

Closure of inactive accounts

In some cases, we may also close accounts that have not been used after a certain amount of time.
